Terms and conditions

Article 1 - This contract concerns the rental of the cottage « Le Fournil », 17 rue de la Mairie, 31580 Loudet (France). It is a small independent house with two bedrooms, a bathroom, a kitchen, a living room and a terrace.

The owner reserves the right to terminate a reservation at any time if one of the following conditions is not fully met. The tenant will then be asked to leave the property.


Article 2 - Length of stay: The minimum length of stay is 3 nights. From 1st July to mid-September, only bookings from Saturday to Saturday (7 nights) are accepted.

The tenant of the present contract concluded for a fixed duration will not be able under any circumstances to take advantage of any right to remain in the premises at the end of the stay.


Article 3 - Conclusion of the contract: The booking becomes effective once the tenant has sent the owner the deposit after confirmation of the request.

The rental concluded between the parties may in no case benefit, even partially, to third parties, natural or legal persons, except with the written agreement of the owner.

Any breach of this last paragraph could lead to the immediate termination of the rental at the fault of the tenant, the rental income remaining definitively acquired by the owner.


Article 4 - Cancellation by the tenant: Any cancellation must be notified as soon as possible by telephone, then confirmed in writing to the owner.

a) Cancellation before arrival at the premises:

If the cancellation occurs less than 30 days before the date of arrival at the premises, the full amount remains acquired by the owner. All cancellations must be made before 11:59 p.m. in the property's time zone.

If the tenant does not show up within 24 hours of the arrival date indicated, this contract becomes null and void and the owner can dispose of his cottage. The total amount remains acquired by the owner.

b) If the stay is shortened during the rental period, the full amount of the reservation remains acquired by the owner. No refund will be made.


Article 5 - Cancellation by the owner: The owner reimburses the tenant all of the sums paid in advance.


Article 6 - Arrival: The tenant arrives on the day specified in the time slot mentioned. In case of late or delayed arrival, the tenant must notify the owner.


Article 7 - Payment of the stay: A down payment of 30 % on the price of the stay is to be paid at the time of booking. The balance of the rental is to be paid at the latest 45 days before the date of arrival. If this deadline is not respected, the owner reserves the right to cancel the booking without notice.

For any reservation made less than 45 days before the date of arrival, full payment is due.


Article 8 - Deposit: A deposit is required by the owner. The deposit is payable, with the balance, at the latest 45 days before the date of arrival. This deposit is returned, by bank transfer or cheque, within two weeks of the date of departure, less the cost of repairing the premises if any damage is noted.


Article 9 - PayPal: If the payment is made by PayPal, an administrative fee will be added, corresponding to 3.5 % of the total cost of the booking (only to cover the fees that PayPal charges to the owner for the use of this service).


Article 10 - Capacity: This rental contract is established for a maximum capacity of 4 people. If the number of occupants exceeds the capacity, the owner can refuse the additional persons. Any modification or breach of the contract will be considered at the initiative of the tenant.


Article 11 - Internet access: Unlimited internet access via Wi-Fi is available free of charge. However, the owner declines all responsibility if any equipment brought by the tenant (for example, a laptop) is unable to connect to or maintain a connection with this facility.


Article 12 - Animals: Domestic pets are not accepted. In case of non-respect of this clause by the tenant, the owner will refuse the stay. In this case, no refund will be made.


Article 13 - Smokers / Non-smokers: Smoking is strictly forbidden in the cottage, throughout the property and in the swimming pool area. Smokers are requested to use an ashtray on the terrace.


Article 14 - Use of the premises: The tenant must ensure the peaceful character of the cottage and make use of it in accordance with the purpose of the premises. Parties/events are not allowed. The tenant must avoid making noise between 10 p.m. and 9 a.m.


Article 15 - Cleaning of the premises: Cleaning in normal use is the responsibility of the owner. In the event of abnormal use of the premises, or excessive soiling, the amount of the cleaning costs will be re-invoiced to the tenant and deducted from the deposit.


Article 16 - Safety: The tenant is responsible for all damage caused by him. Therefore, he stays and uses the facilities (barbecue, swimming pool, etc.) entirely at his own risk. He must take the necessary safety measures during his stay and provide himself with appropriate travel and/or personal accident insurance, health cover or life insurance. Safety and/or protective clothing, sunscreen and first aid equipment must be brought by the tenant for his own use, if required.


Article 17 - Travel insurance: The rental price does not include travel insurance. It is therefore recommended that the tenant takes out travel insurance and travel cancellation insurance to cover the costs in the event of cancellation or unexpected termination of the holiday.

Luggage and personal belongings are at all times at the tenant’s own risk and are therefore exempt from any liability of the owner.


Article 18 - Payment of charges: Water and electricity charges are included in the rental price for normal use. In case of abnormal use, the charges may be re-invoiced to the tenant and deducted from the deposit.


Article 19 - Disclaimer: The use of the property, land, buildings, whether occupied or not, is at the tenant’s risk and no liability is accepted by the owner for any injury, loss or suffering of any kind whatsoever suffered by the tenant or any other occupant of the cottage.

The owner shall not be liable to the tenant for any defect or temporary interruption in the provision of public services to the property, nor in respect of any equipment in the property, garden or grounds, nor for any loss, damage or injury resulting from acts beyond its control. Under no circumstances may the owner's liability to the tenant exceed the amount paid to the owner for the rental period.

This rental contract is governed by French law in all its aspects.


Article 20 - Force majeure: The owner declines all responsibility in the event that the execution of this rental contract is prevented due to: war or threat of war, riots, civil strife, terrorist activities, labour strikes, natural or nuclear disasters, fire, flood or adverse weather conditions, closure of ports or airports, epidemics/pandemics, government measures or any other similar event beyond its control.


Article 21 - Complaints: If, against all expectations, the tenant notices any defects or encounters problems relating to the rental, he must report them immediately to the owner. The latter will ensure that arrangements are made to repair or replace them as soon as possible. No complaint will be considered unless it is brought personally to the attention of the owner as soon as possible, in any case before the cottage is vacated, and confirmed in writing within seven days of the end of the holiday stay.

Any legal dispute will be handled by the competent court.
